European Commission proposal for a Council Decision regarding the 33rd Energy Charter Conference
On 5 October 2022, the European Commission adopted a proposal for an EU Council Decision on behalf of the European Atomic Energy Community (Euratom) under the 33rd Energy Charter Convention.
This upcoming Convention is to adopt the following proposed amendments and modifications to the Energy Charter Treaty (ECT):
1) amending the ECT to align with modern standards of investment protection and EU energy and climate objectives, as set in the United Nations Commission on International Trade Law (UNCITL) and the Paris Agreement.
2) modifying the scope of the ECT to include new renewable and low-carbon technologies and investments needed for green energy.
3) changing ECT language regarding declarations and decisions to remove obsolete provisions or add clarification through definitions.
4) adopting a decision that forces the previous provisions into entry and application.
